2. John Julius Dare: Will & Probate, 17 Sep 1891, Georgetown British Guiana WI.
JOHN JULIUS DARE of the city of Georgetown in the colony of British Guiana and a domiciled inhabitant of the said colony declare this to be my last will and testament hereby revoking annulling and making void all wills and other testamentary dispositions heretofore made by me
Firstly I desire that all my just debts and funeral expenses be paid as soon as possible after my death Secondly I hereby acknowledge that having been married to my present wife Caroline May Dare born Taylor in the said colony on the ninth day of April one thousand eight hundred and seventy four without having-executed any, antenuptial contract she will be entitled in the event of her surviving me to one half of the property held by us in community at the time of my death after payment of my debts and funeral expenses Thirdly I nominate constitute and appoint as executors and trustees to this my last will and testament my said wife so long as she remains unmarried Alexander Russell Gitzean of Plantation Anna Regina Essequebo British Guiana William Samuel Turner of Demerara Jointly and severally with the powers to them and each of them Of assumption substitution and surrogation
Fourthly. I give devise and bequeath all the real and personal estate to which at my death I shall be beneficially entitled and of which I shall have power to dispose beneficially by will for any purpose I may think proper unto the executors and trustees hereinbefore named absolutely Upon trust to sell the said real estate and call in sell and convert into money such part of my personal estate as shall not consist of money with power to postpone such sale and conversion for such a period as they or any of them may think proper and with power to them and each of them and to any assumed substituted or surrogated executor to mortgage to lay out on mortgage And invest on real immoveable, or personal property or security and alter charge and vary any security and to sell transport transfer and accept transports and transfers of any property belonging to me or acquired by my estate provided always that so long as my said wife shall continue to act as one of said executors she shall act jointly with the said Alexander, Russell Gitzean, William Samuel Turner or either of them with any person or persons who may be assumed substituter or surrogated as aforesaid
Fifthly I give and bequeath the proceeds of the whole of the property belonging to me or to which I may be entitled at the time of my death and such portions of the said property as shall not have been converted into money unto such child or children of mine living at my death and such issue thein living of any child or children of mine not dead before me as shall (being males) attain the age of twenty one years or (being females) attain that age or marry in equal shares as between brothers and sisters but so that no child of or any grandchild of mine shall be included in this gift if such grandchild survive me and so that the child and children of any deceased child or grandchild shall take only such share as his her or their parent could have taken if he or she had survived me and had attained a vested interest.
Sixthly I nominate and appoint my said wife so long as she remains unmarried and the said Alexander Russell Gitzean of Essequebo British Guiana jointly and severally guardians of the persons and property of such of my children as may be minors at the time of my death with power to assume substitute or surrogate any persons or persons as such guardian or guardians Provided always that so long as my said wife shall continue to act as guardian as aforesaid. she shall act Jointly with the said Alexander Russell Gitzean or with any person or persons who may be assumed substituted or surrogated as aforesaid And I declare that my executors shall not be answerable for any loss or misfortune except each for his or her own wilful defaults in. the administration of my estate
IN WITNESS. whereof I have hereunto set my hand this seventeenth day of September one thousand eight hundred and ninety one
Signed by the testator the said John Julius Dare as and for his last will and testament in the joint presence of us who at his request and in his presence and in the presence of each other have hereunto subscribed our names as witnesses the alterations against which our initials are placed. having been first made.
