Indenture Dated 7th day of January 1805 Attested Copy The Reverend Thomas Propert and Wife with Mr. Thomas Godfrey Covenant to levy a fine of a Moiety of an estate situate in the Parish of Byfield in the County of Northhampton and to lead the uses thereof. Congreve Stony Stratford This indenture of four parts made the 7th day of January in the forty fifth year of the reign of our Sovereign Lord George the Third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith in the year of Our Lord one thousand eight hundred and five. Between the Reverend Thomas Propert of Stony Stratford in the County of Buckingham Clerk and Mary his wife which said Mary Propert was a niece and Devisee named in the Last Will and Testament of Richard Hiccock late of Westhorp in the Parish of Byfield in the County of Northampton deceased) of the first part John Oliver of Stony Stratford aforesaid gentleman of the second part Elizabeth Propert of the same place spinster (only daughter of the said Thomas Propert and Mary his wife) of the third part and Thomas Godfrey of Stony Stratford aforesaid gentleman of the fourth part WHEREAS a marriage is agreed upon and intended to be shortly had and solemnized by and between the said John Oliver and Elizabeth Propert and upon the treaty for the said intended marriage it was agreed that the undivided moiety or equal half part of the said Thomas Propert and Mary his wife or one of them of and in the messuages Dwellinghouses or Tenement Closes Lands and hereditaments hereinafter mentioned and described should be settled and assured to the uses and to and for the intent and purposes hereinafter mentioned expressed and declared of and concerning the same. NOW THIS INDENTURE WITNESSETH that for and in consideration of the said intended marriage and in pursuance and performance of the said agreement and for settling limiting and assuring the said one undivided Moiety or Equal Half part of and in the said messuages Dwellinghouses or Tenement Closes Lands and hereditaments hereinafter mentioned and described to the several uses and to and for the ends intents and purposes hereinafter mentioned expressed and declared of and concerning the same and also for and in consideration of the Sum of five shillings of lawful money of this United Kingdom current in Great Britain to the said Thomas Propert and Mary his wife in hand well and duly paid by the said Thomas Godfrey at or before the sealing and delivery of these presents the Receipt whereof is hereby acknowledged the said Thomas Propert for himself and the said Mary his wife and his and her heirs doth covenant promise and agree to and with the said Thomas Godfrey and his heirs by these presents that the said Thomas Propert and Mary his wife and their respective heirs shall and will at their own costs and charges in the law as of the last Michaelmas Term the next Hilary Term or some other subsequent Term acknowledge and levy in due form in Law before His Majesty's Justices of the Court of Common Pleas at Westminster unto the said Thomas Godfrey and his heirs one or more Fine or Fines Sur conveyance de droit come ceo with Proclamations to be thereupon had and made according to the form of the Statute in that case made and provided and the usual course of levying fines in such cases used and accustomed of All that undivided Moiety or equal half part ( the whole into two equal arts to be divided) of and in All that messuages Tenement or Farm House wherein the said Richard Hiccock did formerly inhabit and dwell situate and being in Westhorp aforesaid with the outhouses barns stables malting office and other buildings yard garden home close Homestall and appurtenances thereunto belonging and therewith now used And also of and in all those five closes or enclosed grounds situate and being in the new Inclosures in Westhorp aforesaid to the said Messuage or Tenement belonging and therewith now used formerly also in the tenure or occupancy of the said Richard Hiccock his assignee or assigns And also of and in all that small messuage or tenement near adjoining the said Tavernhouse formerly in the tenure or occupancy of John Turner with the Garden Ground and appurtenances thereunto belonging all which said messuages lands premises are now in the tenure or occupancy of Robert French of Westhorp aforesaid yeoman or his undertenants All which Messuages Dwellinghouses or Tenement Closes Lands Hereditaments and premises hereintofore described were late the Estate and Inheritance of the said Richard Hiccock deceased and were in and by his last Will and Testament bearing date on or about the sixth day of October in the year of our Lord one thousand seven hundred and eighty one given and devised (from and after the decease of the said Testator's Sister Mary Hiccock deceased) unto his nieces Ann Edwards and the said Mary Propert their heirs assigns for ever as tenants in common and not as joint tenants and also the like one undivided moiety or equal half part of and in all other messuages dwellinghouses or tenement closes lands and hereditaments whatsoever which in and by the said will of the said Richard Hiccock deceased were given and devised unto the said Ann Edwards and Mary Propert and their heirs and assigns as aforesaid. Together with the like one undivided moiety or equal half part of and in all houses outhouses edifices buildings hedges ditches gates rails stiles mounds and fences ways waters watercourses easements commons profits privileges advantages emoluments hereditaments rights members and appurtenances whatsoever to the said messuages dwellinghouses or tenement closes lands and hereditaments and premises hereinbefore mentioned and described or any of them or any part or parcel of them belonging or in any wise appertaining or therewith or with any part or parcel thereof usually used held occupied or enjoyed or accepted refuted deemed taken or known as part parcel or member thereof or of any part thereof respectively And the reversion or reversions remainder and remainders yearly and other rents issues and profits thereof. And all the estate right title interest inheritance use trust property claim and demand whatsoever both at law and in equity of the said Thomas Propert and Mary his wife or either of them of in to or out of the same premises every or any part of parcel thereof by such apt and fit names descriptions quantities qualities of land and other particulars and in such manner and form as shall be advised and thought fit for the purpose. And it is hereby declared and agreed by and between all the said parties to these presents that as well the said Fine or Fines so as aforesaid or in any other manner or at any other time levied or to be levied of the of the ….one undivided moiety or equal half part of and in the said messuages dwellinghouses or tenements gardens outhouses barns stables malting office and other buildings closes or new enclosed grounds lands hereditaments and premises or any of them or any part or parcel thereof by or between the said parties to these presents or any of them or whereunto they or any of them is are or shall be party or parties privy or privies shall be and enure and shall be ajudged deemed construed and taken to be and enure and so are and were meant and intended to be and enure and the Cognizee or Cognizees in the said Fine or Fines named or to be named and his or their heirs shall stand and be seised of the said one undivided moiety or equal half part of and in the said Messuages Dwellinghouses or Tenement Gardens Outhouses Barns Stables Malting Office and other buildings Closes or new inclosed Grounds Land hereditaments and premises with their and every of their appurtenances To for and upon the several uses estates intents and purposes hereinafter expressed and declared of and concerning the same that is to say To the use of the said Mary Propert her heirs and assigns until the solemnization of the said intended marriage and from and immediately after the solemnization thereof To the use of the said Thomas Propert and his assigns for and during the term of his natural life without impeachment of or for any manner of waste and from and immediately after his decease To the use of the said Mary Propert and her assigns for and during the term of her natural life without impeachment of or for any manner of waste And from and immediately after the several deceases of the said Thomas Propert and Mary his wife and the decease of the Survivor of them To the use of the said John Oliver and his assigns for and during the term of his natural life without impeachment of or for any manner of waste And from and immediately after the several deceases of the said Thomas Propert and Mary his wife and John Oliver and the deceasese of the survivor of them To the only proper use and behoof of the said Elizabeth Propert her heirs and assigns for ever and to and for no other use estate intent or purpose whatsoever In witness thereof the said parties to these presents have herewith set their hands and seals on the day and year first above written Thomas Propert Mary PropertElizabeth PropertThomas Godfrey Sealed and Delivered by he within named Thomas Propert and Mary his wife and Elizabeth Propert in the presence of Rich. The Christian Observer July 1806 At Stony Stratford, Bucks, aged 57, the Rev Thomas Propert, perpetual curate of that parish of which he has been minister 28 years. Also reported in Gentlemans Magazine and various other publications.
Will Thomas Propert 22 Feb 1805 In the Name of God Amen I Thomas Propert of Stony Stratford in the County of Berkshire Clerk do make publish and declare this my last Will and Testament in manner and form following I give and devise all that Messuage or tenement wherein I now inhabit and dwell in Stony Stratford aforesaid together with the cottage in the Alley now in the occupation of . . . . . West unto my wife Mary Propert during the term of her natural life and from and after her decease I give and bequeath the aforesaid tenements to the use and sole disposal of my daughter Elizabeth Oliver of Stony Stratford aforesaid my personal estate household furniture money in the hands? etc I give and bequeath to my said wife Mary Propert for her sole use to be at her disposal and I hereby make ordain and appoint the said Mary Propert sole executix of this my last Will and Testament in witness whereof I have set my hand and seal this twenty second day of February in the year of our Lord one thousand eight hundred and five Signed Thomas Propert. Signed sealed published and declared by the testator Thomas Propert as and for his last Will and Testament in the presence of us who have set our hands as witnesses thereto. This Will was proved at London on the second day of July in the year of our Lord one thousand eight hundred and six before the right honourable Sir William Toynne? Knight and Dr of Laws Master Keeper and Commissary the Prerogative Court of Canterbury lawfully constituted by the oath of Mary Propert widow the relict of the deceased and the sole executrix named in the said Will to whom administration was granted of all and singular the goods chattels and credits of the deceased having been first sworn only to administer.
