John Ernle ('Ernle') Money (1812-1894), later called John Ernle Money-Kyrle, succeeded his brother in 1868. He married firstly Harriet Louisa Sutton (d.1857) and secondly Ada Frances Simons (d.1918) and had children by both wives. He served in the 32nd regiment of foot (ensign 1833, captain 1843) and ended his military career as lieutenant-colonel. Like his brother William, he served in the Herefordshire Militia and as Deputy Lieutenant for Herefordshire.

1. John Ernle Money Kyrle: Will, 21 Dec 1889.
I JOHN ERNLE MONEY KYRLE of Homme House in the Parish of Much Marcle in the County of Hereford Esquire a Lieutenant Colonel in Her Majesty's Army hereby revoke all former wills codicils and other testamentary dispositions heretofore made by me and declare this to be my last will I direct that all my just debts and my funeral and testamentary expenses shall be paid as soon as conveniently can be after my decease out of my residuary personal estate hereinafter bequeathed and I appoint my beloved wife Ada Frances Money Kyrle and my eldest surviving son Audley Walter Washbourne Money Kyrle to be EXECUTRIX and EXECUTOR of this my will and I also appoint my said wife during her life and after her decease the said Audley Walter Washbourne Money Kyrle to be the sole guardian of the persons and fortunes of such of my children as at the time of my decease shall be under the age of twenty one years during their respective minorities I give and devise unto the said Audley Walter Washbourne Money Kyrle and The Reverend John Cruger Murray Aynsley and my son in law Andrew Pope and their heirs all that the advowson donation right of patronage and presentation of and to the Vicarage and parish Church of Much Marcle aforesaid Upon trust that they the said Audley Walter Washbourne Money Kyrle John Cruger Murray Aynsley and Andrew Pope or the survivors or survivor of them or the heirs executors or administrators of such survivor shall when and so soon as the said Church shall happen to become void by any means whatsoever present my third surviving son Cecil Leigh Money Kyrle thereto in order that he may be admitted instituted and inducted to the same in case he shall then be a Clerk in Holy Orders capable of taking the said Benefice but if he he shall not then be capable of taking the same then shall present some other fit and proper person thereto and when and so soon as the said Church shall be first void next after the said Cecil Leigh Money Kyrle shall be capable of taking the same shall present him thereto so that he may be admitted instituted and inducted to the said Church and subject to the trust in favor of the said Cecil Leigh Money Kyrie herein -before declared or if he shall neglect to qualify himself to take the said Church or shall refuse to be presented thereto then and from thenceforth I declare that the said Audley Walter Washbourne Money Kyrle John Cruger Murray Aynsley and Andrew Pope and their heirs shall stand seized of the said Advowson to such and the same uses as are hereinafter declared of and concerning my manors and real estate hereinafter devised and as part thereof I give and devise all my manors and other real estate whatsoever and wheresoever situate and of what nature or kind soever over which I have or at my decease shall have any disposing power with their appurtenances to the uses upon the trusts and with and subject to the powers and provisions hereinafter expressed and declared of or concerning the same that is to say to the use and intent that my wife the said Ada Frances Money Kyrle or her assigns shall and may during her natural life receive and take a yearly rent charge of eight hundred pounds to be issuing out of and charged upon my said manors and real estate and to be payable by four equal quarterly payments in every year without any deduction whatsoever and free of income or property tax the first quarterly payment of the said rent charge to become due and be made at the expiration of three calendar months from my decease and I hereby direct that my said wife if she shall so long live shall with and out of the said rent charge of eight hundred pounds hereinbefore limited maintain bring up and keep a home for my three unmarried daughters until they shall respectively marry (and for my two younger sons Rowland Tracy Ashe Money' Kyrie and the said Cecil Leigh Money Kyrle until they shall respectively attain the age of twenty five years or marry under that age but not so as to affect the provisions for the education of my said younger sons and my youngest daughter hereinafter contained And as to my said manors and real estate subject and charged as aforesaid to the use and intent that my said wife and in the event of her decease the said Audley Walter Washbourne Money Kyrle John Cruger Murray Aynsley and Andrew Pope or the survivors or survivor of them or the executors or administrators of such survivor or other the trustees or trustee for the time being of this my will (all of whom are hereinafter included in the expression my said trustees or trustee) shall receive and take for the education maintenance preferment and advancement of my said son Rowland Tracy Ashe Money Kyrle a clear yearly rent charge of one hundred pounds to commence from the day of my decease and to continue if he the said Rowland Tracy Ashe Money Kyrle shall so long live until he shall attain the age of twenty five years or marry under that age and to the further use and intent that my said wife or in the event of her decease my said trustees or trustee shall receive and take for the education maintenance preferment and advancement of my said son Cecil Leigh Abney Kyrie a like clear yearly rent charge of one hundred pounds to commence from the day of my decease and to continue if he the said Cecil Leigh Money Kyrie shall so long live until he shall attain the age of twenty. five years or marry under that age and to the further use and intent that my said wife, and in the event of her decease my said trustees or trustee shall receive and take for the education maintenance and bringing up of my youngest daughter Violet Ernie Ada Money Kryle,a clear yearly rent charge of one hundred pounds to commence from the day of my decease and to continue if she the said Violet Ernie Ada Money Kyrie shall so long live until she shall attain the age of twenty one years or marry under that age the said three several rent charges of one hundred pounds each hereinbefore limited to be payable and paid by equal half yearly payments in every year and the first half yearly payment thereof respectively to become due and be made at the expiration of six calendar months from the day of my decease and in case at the decease of my said wife the said Rowland Tracy Ashe Money Kyrle and Cebil Leigh Money Kyrle or either of them shall be under the age of twenty five years or if the said Violet Ernie Ada Money Kyrie shall be then under the age of twenty one years and unmarried then to the further use and intent that my said trustees or trustee shall receive and take for the education and maintenance of each or either of them the said Rowland Tracy Ashe Money Kyrle and Cecil Leigh Money Kryle who shall be under the age of twenty five years and for the education maintenance and bringing up of the said Violet Ernie Ada Money Kyrle if she shall then be under the age of twenty one years and unmarried a further yearly rent charge of one hundred pounds to commence from the decease of my said wife and to continue if the son or daughter for whom the same rent charge is hereby provided shall so long live until such son shall attain the age of twenty five years or such daughter shall attain the age of twenty one years or marry under that age each such last mentioned yearly rent charge to be payable and paid by equal half yearly payments in every year and the first half yearly payment thereof to become due and be made at the expiration of six calendar months from the day of the decease of my said wife and for the purpose of securing and enforcing payment of the several rent charges hereinbefore limited I declare that my said wife and my said trustees or trustee as the case may be shall have and may exercise all statutory powers and remedies for the time being subsisting for the recovering of rent charges charged upon real estate and I direct my said wife and in the case of her decease the trustees or trustee for the time being of this my will to apply the several rent charges hereinbefore respectively limited for the benefit of my sons the said Rowland Tracy Ashe Money Kyrle and Cecil Leigh Money Kyrle respectively and of my daughter the said Violet Ernie Ada Money Kyrie for or towards the maintenance and education either at College or elsewhere as may be decided upon of such sons respectively and of such daughter at such places as my said trustees or trustee shall think fit and subject to and charged with the said several rent charges hereinbefore limited and the powers and remedies for the recovery thereof I direct that my said manors and real estate hereinbefore devised shall go remain and be to the use of the said Addley Walter Washbourne Money Kyrle and his assigns for his life with remainder to the use of his first and every other son severally add successively according to seniority in tail male with remainder to the use of the said Rowland Tracy Ashe Money Kyrle and his assigns for his life with remainder to the use of his first and every other son severally and successively according to seniority in tail male with remainder to the use of the said Cecil Leigh Money Kyrle and his assigns for his life with remainder to the use of his first and every other son severally and successively according to seniority in tail male with remainder to the use of my fifth and every other son hereafter to be born according to his priority in birth for his life with remainder to the use of his first and every other son severally and successively according to seniority in tail male with remainder to the use of the first or eldest son of the eldest daughter of the said Audley Walter Washbourne Money Kyrie in tail male with remainder to the use of the first or eldest son of the second and every other daughter of the said Audley Walter Washbourne Money Kyrle according to her priority of birth in tail male with remainder to the use of the eldest son of my eldest daughter Harriet Mary Ernie Pope the wife of the said Reverend Andrew Pope in tail male with remainder to the use of the eldest son of my second and every other daughter according to her priority of birth in tail male with remainder to the use of my own right heirs And I declare that each life estate hereinbefore limited shall be unimpeachable for waste except voluntary waste on pulling down houses or buildings and not rebuilding the same or others of equal or greater value and to protect the contingent estates hereinbefore limited I devise the said manors and real estate hereinbefore devised from and after the determination of the estate hereinbefore limited to any person during his life by forfeiture or otherwise in his lifetime to the use of the said Audley Walter Washbourne Money Kyrie John Cruger Murray Aynsley and Andrew Pope their executors administrators and assigns during the life of the tenant for life whose estate shall so determine upon trust to protect the contingent estates depending thereon Provided always that if any person to whom the said Manors and real estate hereinbefore devised are hereinbefore limited for an estate or interest in tail male shall be born in my lifetime then and in every such case I hereby revoke the devise hereinbefore made to such person and in lieu thereof I give and devise the said manors and real estate to the use of such person for his life only and from and after the determination of that estate by forfeiture or otherwise in his lifetime to the use of the said Audley Walter Washbourne Money Kyrle John Cruger Murray Aynsley and Andrew Pope their executors administrators and assigns for the life of the person so made tenant for life as last aforesaid Upon trust to protect contingent estates and immediately after the decease of such tenant for life to the use of his first and every other son severally and successively according to seniority in tail male Provided always and I hereby declare and direct that every person who under the uses hereinbefore contained shall become entitled to the actual receipt of the rents and profits of the said Manors and real estate hereby devised and who shall not then use the surname of Money-Kyrle or bear the arms of Money Kyrle shall within the space of one year next after he shall become entitled as aforesaid or if an infant shall so become entitled then within the space of one year next after he shall have attained. the age of twenty one years take and use upon all occasions the surname of Money Kyrie only and to quarter the arms of Money Kyrle with his own family arms and shall within the space of one year next after the periods herein before respectively prescribed apply for and endeavour to obtain an Act of Parliament or a proper License from the Crown or take such other means as may be necessary to enable him to take use and bear the surname of Money Kyrle only and to quarter the Arms of Money Kyrle and in case any of the said persons shall refuse or neglect or discontinue to take or use such surname and arms or to take such means as may be requisite for the purpose of taking or using the same then after the expiration of the said space of one year the use and estate hereby limited to the person who shall so refuse neglect or discontinue as aforesaid and also the limitation hereinbefore contained to the use of the said Audley Walter Washbourne Money Kyrle John Cruger Murray Aynsley and Andrew Pope their executors administrators and assigns during the life of such person in case he shall be tenant for life of the said manors and real estate shall absolutely cease and determine and immediately thereupon the said manors and real estate shall go over to the uses and in the manner to and in which the same would have gone if the person who shall so refuse neglect or discontinue as aforesaid being tenant for life thereof were then actually dead or being tenant in tail male were then dead without issue inheritable under the same entail and for the preservation of the contingent limitations herein -before contained I devise as follows that is to say as often as there shall by reason of the aesser of any of the uses and estates hereinbefore limited be a suspense or contingency of the then next immediate expectant remainder I devise the said manors and real estate to the use of the said Audley Walter Washbourne Money Kyrle John Cruger Murray Aynsley and Andrew Pope their executors administrators and assigns during every such suspense or contingency as aforesaid in trust to preserve the contingent uses and estates hereinbefore limited from being destroyed and upon the further trust to receive the yearly rents and profits of the said manors and real estate and to pay the same after providing for the expenses of repairs insurance and management to the person then for the time being entitled to the first vested estate in the said manors and real estate And I hereby empower the said Audley Walter Washbourne Money Kyrle and also each of the several other persons hereby respectively made tenants for life of the said manors and hereditaments hereinbefore devised either before or when he shall by virtue of the limitations hereinbefore contained become entitled to the possession or to the receipt of the rents and profits of the same manors and hereditaments by deed with or without power of revocation and new appointment or by will or codicil (but subject to the uses antecedent to the use hereinbefore limited to the person for the time being executing this present power and to the powers annexed to such antecedent uses and subject also to the estates to be limited in exercise of the same powers) from time to time to charge the said manors and hereditaments or any part thereof with the payment of any annual sum or sums to any woman whom he shall marry or shall have married for her life by way of jointure and either in bar or without being in bar of dower to be payable quarterly or half yearly with the usual powers for securing the same so as such annual sum or sums do not exceed for any one such woman the sum of three hundred pounds Provided nevertheless that the said Audley Walter Washbourne Money Kyrie shall not be entitled to exercise the power of jointuring hereinbefore contained in favor of his wife Florence Cecilia Money Kyrle for whom in contemplation of her marriage a yearly rent of four hundred pounds charged upon and issuing out of certain hereditaments in the said County of Hereford was provided by an Indenture dated the seventeenth day of September one thousand eight hundred and eighty seven such rent to be payable from the decease of the said Audley Walter Washbourne Money Kyrle in case the said Florence Cecilia Money Kyrle shall survive him and during the then remainder of her life Provided always that the said manors and hereditaments hereinbefore devised shall not by virtue of the aforesaid power at any one time be liable to the payment of more than the annual sum of five hundred pounds for jointures so that if by virtue of the said power the same hereditaments would in case this present proviso had not been herein inserted have been charged with any greater annual sum in the whole than the sum of five hundred pounds the payment of the annual sum occasioning such excess or such part thereof as shall occasion the same shall during the period of such excess be suspended Provided also that no jointure limited under the power aforesaid shall become payable during the life of my said wife And whereas under the will of my late brother William Money Kyrle deceased which will is dated the seventeenth day of March one thousand eight hundred and sixty eight certain estates in the Counties of Wilts Hereford and Northampton were limited to trustees for the term of five hundred years upon trust to accumulate the surplus rents of such estates for paying off three several mortgage debts of sixteen thousand pounds fourteen thousand pounds and one thousand five hundred pounds charged thereon and subject thereto to the said Audley Walter Washbourne Money Kyrie and his assigns during his life with remainder to the first and every other son of the said Audley Walter Washbourne Money Kyrie according to seniority in tail male with divers remainders over Now if and so soon as in consequence of the satisfaction of the said mortgage debts the said Audley Walter Washbourne Money Kyrie or any son of his shall come into the actual possession or the receipt of the rents and profits of the same estates then I give and bequeath to each of my other children who shall then be living the legacy of one hundred pounds. and I hereby charge the manors and real estate hereinbefore devised with the payment of each such sum of one hundred pounds I give and bequeath to my said wife absolutely all my private letters and also my wearing apparel and I also give and bequeath to her the legacy or sum of five hundred pounds to be paid to her within three calendar months after my decease for her immediate use and I give and bequeath to my said son Rowland Tracy Ashe Money Kyrie if and when he shal attain the age of twenty five years the legacy or sum of two thousand five hundred pounds and to my said son Cecil Leigh Money Kyrle if and when he shall attain the age of twenty five years the legacy or sum of two thousand pounds but subject to the provisions for postponing such payment hereinafter contained give and bequeath to my said son Audley Walter Washbourne Money Kyrie and the said John Cruger Murray Aynsley and Andrew Pope the sum of two thousand pounds Upon trust that my said trustees.or trustee shall invest the said sum of two thousand pounds in their or his names or name or under their or his legal control in or upon any of the public stocks, or funds or government securities of the United Kingdom or the Empire of India or of any British Colony or Dependency or upon freehold copyhold or leasehold securities in England or Wales and not elsewhere and so that a term of sixty years at the least shall be subsisting in any leasehold premises which shall be accepted as a security or in or upon the mortgages bonds or debentures or the guaranteed preference debenture or ordinary stocks or guaranteed or preference shares of any Railway or other joint Stock Company in the United Kingdom incorporated by Act of Parliament or Royal Charter or in or upon any stocks funds or securities authorised by Law as investments for Trust Funds and may from time to time vary and transpose such stocks funds shares and securities into or for others of the same or the like nature and shall pay the income of the stocks funds shares and securities to arise from the investment hereinbefore directed to my daughter the said Harriet Mary Ernie Pope during her life for her separate use free from the debts control or engagements of her present or any future husband and so that she shall not have power to deprive herself of the benefit thereof in any mode of anticipation and so that her receipts alone shall be sufficient discharges for the same and from and immediately after the decease of the said Harriet Mary Ernie Pope in case the said Andrew Pope shall survive her shall pay the said income to the said Andrew Pope or his assigns. during his life for his and their own use and benefit and from and immediately after the decease of the survivor of them the said Andrew Pope and Harriet Mary Ernie Pope I direct that my said trustees or trustee shall stand and be possessed of the stocks funds shares and securities constituting or representing the said sum of two thousand pounds lastly hereinbefore bequeathed and the income thereof Upon trust for all and every the children and child of the said Harriet Mary Ernie Pope who being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry under it and if more than one in equal shares and if there shall be only one such child then Upon trust for such only child and I give and bequeath to each of may younger daughters Alice Eleanor Money Kyrie Eugenia Emma Money Kyrle and the said Violet Ernie Ada Money Kyrie who has attained or shall attain the age of twenty one years during her natural life if she shall so long continue unmarried an annuity or clear yearly sum of fifty pounds for pocket money to be payable by equal half yearly payments in every year and in case either or any of my said younger daughters shall marry either before or after attaining the age of twenty one years then in lieu of such annuity of fifty pounds I give and bequeath to each such daughter so marrying the legacy or sum of two thousand pounds for her absolute use to be paid immediately upon the marriage of such daughter but subject to the provisions for postponing such payment hereinafter contained and if all my said three daughters Alice Eleanor Money Kyrle Eugenia Emma Money Kyrie and Violet Ernie Ada Money Kyrie shall survive my said wife and shall not have married in her lifetime or in my lifetime if I shall survive my said wife then I limit and bequeath unto them the said Alice Eleanor Money Kyrie Eugenia Emma Money Kyrie and Violet Ernie Ada Money Kyrle and to the survivors of them during their joint lives and to the last survivor during her life and so long as they or she respectively shall continue unmarried in addition to the annuity of fifty pounds hereinbefore given to each of them an annuity or yearly rent charge of five hundred pounds free of income and property tax such yearly rent charge to be payable without any deduction by equal quarterly payments in each year the first payment to become due and be made at the expiration of three calendar months after the decease of my said wife or if I shall survive her after my decease and I charge all the manors and real estate hereinbefore devised with the payment of the several legacies and annuities hereinbefore bequeathed to my younger sons and to my daughters respectively including the said sum of two thousand pounds hereinbefore bequeathed for the benefit of the said Harriet Mary Ernie Pope and her husband and children And I hereby declare that it shall be lawful for my said son Audley Walter Washbourne Money Kyrie or any other person or persons for the time being entitled under the limitations of this my will to the possession or receipt of the rents and profits of my said manors and real estate hereby charged with the payment of the said legacies of two thousand pounds or two thousand five hundred pounds to each of my said younger sons and to each of my said three younger daughters respectively upon her marriage as aforesaid and to or for the benefit of my said daughter Harriet Mary Ernie Pope and her husband and children to postpone the payment of any such legacies which may become payable under the provisions of this my will for the period of five years or any less period after the same shall have become payable but nevertheless the said Audley Walter Washbourne Money Kyrle or other the person or persons for the time being entitled as aforesaid shall from time to time during such postponement of payment pay to the son or daughter entitled to any such legacy the payment of which shall be postponed or to the trustees or trustee for my said daughter Harriet Mary Ernie Pope her husband and children as aforesaid or to other the person or persons for the time being entitled thereto under the provisions herein contained interest for the same at the rate of four per cent per annum by equal half yearly payments in every year the first payment of interest on such legacy to become due and be made at the expiration of six calendar months after the same legacy shall have become payable and I give and bequeath to my gardener James Maxton and to my servant Mary Ann Lucy Evans the sum of fifteen pounds each free of legacy duty and to my butler Alfred Collett and to my coachman James Rowberry and my servant Eliza England and to any domestic servant who shall have lived with me continuously for five years at the time of my decease a legacy of five pounds free of any legacy duty if he or she respectively shall be in my service at the time of my decease and I give to my old servant Elisabeth Chadwick the sum of ten pounds free of any legacy duty and I give my portrait in oil by Walker unto my said wife during her life and I give and bequeath, all my plate and all the paintings and pictures in the dlning room and drawing room at Homme House and the Kyrle or Man of Ross Chair and also after the death of my said wife my said portrait in oil unto the trustees or trustee for the time being of my said will their or his executors' administrators and assigns upon such trusts snd for such intents and purposes as will best and nearest correspond with the uses and limitations hereinbefore declared and contained of and concerning my said manors and realestate hereinbefore devised or such and so many of the said uses and limitations as shall at the time of my decease be subsisting and capable.of taking effect and so that the said plate paintings pictures chair and after my said wifes death my said portrait may devolve as or in the nature of heirlooms with the said devised manors and real estate so long as the Rules of Law will permit but nevertheless the said plate paintings pictures chair and portrait shall not vest absolutely in any person hereby made tenant in tail male by purchase of the said hereditaments thereby devised in strict settlement who shall not attain the age of twenty one years but on his decease under that age shall go and devolve in the same manner as if such plate paintings pictures chair and portrait had been freehold of inheritance and had been included in the devise in strict settlement hereinbefore contained I also give and bequeath to my said wife in addition to the legacy given to and provision hereinbefore made for her all my household furniture china books linen and pictures and other household effects not hereinbefore specifically bequeathed and all my horses carriages live and dead farming stock and other indoor and outdoor effects to and for her own absolute use and benefit and subject to the payment of my debts and funeral and testamentary expenses I give and bequeath all the residue of my personal estate and effects whatsoever and wheresoever and of what nature or kind soever not hereinbefore specifically bequeathed unto my said son Audley Walter Washbourne Money Kyrle for his own absolute use and benefit I hereby declare that the said Audley Walter Washbourne Money Kyrle John Cruger Murray Aynsley and Andrew Pope and the survivors and survivor of them or the executors or administrators of such survivor or other the trustees or trustee for the time being of this my will are hereby appointed trustees hereof for all the purposes of the Settled Land Act and also for all the purposes of Section 42 of the Conveyancing and Law of Property Act and that if and so long as there is only one trustee of this my will capital money arising under the Settled Land Act or this my will may notwithstanding anything in the act contained be paid to such one trustee and further that all the powers conferred on trustees by the Settled Land Act may be exercised by one trustee only and all the provisions of that Act applicable to trustees including notices under section 45 shall be satisfied though there may be only one trustee for the time being in existenee of this my will and in addition to the ordinary powers and indemnity and right to reimbursement by law given to trustees my said trustees or trustee shall be at liberty to lend on any security with less than a marketable title and shall not be answerable for any loss thereby occasioned or for any other loss to the trust estate unless such loss shall happen or be occasioned by reason of their or his
