TURNER v. ALSTON. Bill, 6 December 1682, by John Turner of London, merchant, v. Elizabeth Alston, daughter of Samuel Alston, late of Marlsford, co. Suffolk, gent., decd., by Elizabeth his wife, sister of Thomas Mann, late of Yoxford, gent. Complainant is seised of an estate of inheritance called Mayden's Hall, in Stoke, near Ipswich, which he purchased about 20 years since from the said Thomas Mann for L1800; they were then charged with a yearly rent of L24, granted by Edward Mann, gent., father of the said Thomas, to the defendant, then an infant, which he was informed was granted as a security for the payment of L400, and not as a perpetual incumbrance. Complainant has offered the said sum to defendant, but she contends the yearly rent-charge was to be of perpetual continuance. The answer of Elizabeth Alston recites a deed dated 3 February 1648, referring to settlements made on his marriage with his wife Dorothy (then Dorothy Mannock, spinster, daughter of Bridget Mannock of Ipswich, widow), which settlements were dated 12 October 1625. Her mother Elizabeth was eldest daughter of the said Edward Mann. The grant was made 9 May 1650 on the marriage of her mother to Samuel Alston, who was then under age ; she died before her said husband was twenty-one, leaving the defendant an infant about 11/2 years old.
