5. John Dives: Will & Probate, 28 Mar 1901. THIS IS THE LAST WILL AND TESTAMENT of me JOHN DIVES of Anneslea East Grinstead in the county of Sussex Gentleman I appoint my dear wife Mary Dives and my son Henry Alston Stuart Dives (hereinafter called "my trustees") to be the EXECUTORS and trustees of this my Will I devise my freehold dwellinghouse shop outbuildings orchard and meadow together with about five acres of other meadow land situate at Dormans Land Lingfield in the county of Surrey known as the Post Office lately in the occupation of Alfred Whitmell and now of Andrews and Isted unto my son absolutely I bequeath to my said wife all my wines liquors fuel and other consumable provisions and also the sum of fifty pounds to be paid to her within one month after my decease and I also bequeath to her the use of all my furniture plate linen china glass books pictures prints and other household effects during her life I give devise and bequeath all the rest of my real and personal estate unto my trustees Upon trust after payment thereout of my funeral and testamentary expenses and debts and the legacy hereinbefore bequeathed to invest such portion thereof as shall not be in a state of investment and stand possessed of my real property and the investments representing my personal property hereinafter called "the trust premises" In trust to pay the income thereof to or permit the same to be received by my said wife during her life but subject to the payment thereout of the sum of thirty pounds per annum to my daughter Katherine Jane Dives And after the death of my said wife as to the furniture plate linen china glass books pictures prints wines liquors and other household effects which shall at my death be in and about my dwellinghouse (but not including any musical instruments or other property belonging to my said son or daughter) Upon trust to divide the same unto and equally between my said son and daughter as nearly as possible in equal shares as they shall choose As to my fifty shares in the London and County Banking Company Limited (or the monies or investments of monies representing the same if the same shall have been sold or the proceeds thereof reinvested before the death of my said wife) Upon trust for my said daughter absolutely And as to the residue of the trust premises Upon trust for my said son absolutely And I direct that the shares of my said son and daughter in the trust premises shall vest in them absolutely at my decease notwithstanding but subject to the life interest therein hereby given to my said wife And I direct that my trustees shall have power to continue any investments made by me in my lifetime and may from time to time vary such investments and I declare that all monies liable to be invested under this my Will may be invested in any stocks funds or securities for the time being authorised by law for the investment of trust funds or on real or leasehold securities in England such lease-holds having not less than sixty years unexpired at the times of the advances thereon respectively or in the purchase of freehold ground rents and in lending money on any mortgage security my trustees may accept whatever title or evidence of title shall appear to them sufficient And in particular may in the case of leasehold securities waive the production of the lessors title without being answerable for any loss arising thereby andmy trustees may release any part of the property comprised in any mortgage security if satisfied that the remaining property is a sufficient security for the money owing thereon And I also declare that the power of appointing new trustees conferred by Statute shall for the purposes of this my Will be vested in my said wife during her life And I direct that my trustees shall at any time during the lifetime of my said wife have power to advance out of the trust premises any sum or sums not exceeding in the whole the sum of five hundred pounds to my said son for his advancement or benefit such advances to be taken into account and as part of his share of my said estate upon the distribution there-of and that the same may be paid to him free from payment of interest thereon to my said wife And lastly I revoke all former wills IN WITNESS whereof I have hereunto set my hand this fifteenth day of September one thousand eight hundred and ninety nine JOHN DIVES SIGNED by the said John Dives the testator and declared to be his last Will in the presence of us present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses Francis S WHITE Solicitor East Grinstead ANN CLARK East Grinstead Spinster ON the 28th day of March 1901 Probate of this Will was granted to Mary Dives and Henry Alston Stuart Dives the Executors.
