Audley Walter Washbourne Money-Kyrle (1846-1908) succeeded to the family estates, as eldest surviving son, in 1894. He married Florence Cecilia Smith-Bosanquet (1860-1930) and left a son and two daughters. He was in India in the army (ensign 1866, lieutenant 1871), and attained the rank of major, after having served in the 55th and 19th regiments. Like his father and uncle he was Deputy Lieutenant for Herefordshire. His son Roger was only ten years old when Audley died. I AUDLEY WALTER WASHBOURNE MONEY-KYRLE of Homme House in the County of Hereford and Whetham near Calne in the County of Wilts a Major in His Majesty's Army hereby revoke all testamentary dispositions heretofore made by me and declare this to be my last will Which I make this sixteenth day of July one thousand nine hundred and one 1. I appoint my wife Florence Cecilia Money Kyrie sole EXECUTRIX and trustee hereof but if she shall predecease me I appoint my brother the Reverend Rowland Tracy Ashe Money Kyrle Vicar of Bewdley Worcestershire and Robert Leathern Barclay of Lombard Street Banker EXECUTORS and trustees hereof 2. I declare that the expression my trustees throughout this my will shall wherever the context so admits include the person or persons for the time being acting as trustees or trustee hereof 3. I appoint my wife during her life and after her death my sisters in law Miss Marion Smith Bosanquet and Miss Ella Smith Bosanquet and the said Rowland Tracy Ashe Money Kyrle and the survivors and survivor of them to be guardian and guardians of my infant children during their respective minorities 4. I bequeath to my wife absolutely all my watches jewels trinkets personal ornaments and wearing apparel and all my furniture plate plated goods linen china glass hooks manuscripts pictures prints statu-ary musical instruments articles of vertu and all other articles of personal domestic or household use or ornament wines liquors and consumable stores and provisions and all my carriage and saddle horses carriages harness saddlery and stable furniture and all my plants and garden tools and implements and I request my wife (but not so as to impose any obligation upon her precatory or otherwise) to make such gifts thereout to our children as I may have verbally indicated during my lifetime In the event of the death of my wife during my lifetime I bequeath the articles mentioned in this paragraph to my son Roger Ernle Loney Kyrle absolutely 5. I devise all my real estate to the following uses that is to say To the use of my said wife during her life with remainder To the use of my first and other sons successively according to seniority in tail with remainder To the use of my first and other daughters successively according to seniority in tail with remainder to the use of my own right heirs for ever 6. I bequeath all the personal estate not hereby or by any codicil hereto otherwise disposed of and which I can dispose of in any manner I think proper either as beneficially entitled thereto or under any general power unto the trustees hereinbefore named Upon trust that my trustees shall call in sell and convert into money such part of my personal estate as shall not consist of money with power to postpone such sale and conversion during any period which my trustees shall think proper and so that no reversionary interest shall be sold until it falls into possession unless my trustees shall see special reason for sale as to which I give my trustees absolute discretion 7. My trustees shall out of the money to arise from the sale and conversion of my personal estate and out of my ready money pay my funeral and testamentary expenses and debts and pay and provide for any legacies or. annuities bequeathed hereby or by any codicil hereto (but so that all legacies and annuities shall be paid primarily out of my personal estate and shall invest the residue of the said money in the name of my trustees in or upon any of the investments hereinafter authorised with power at discretion from time to time to change any investments for the time being held on the trusts hereof for any others of the authorised description 8. I direct that my trustees shall stand possessed of the investments hereinbefore directed to be made or authorised to be retained (hereinafter called the trust fund) and of the income thereof upon the following trusts 9. trustees shall pay the income of the trust fund to my said wife during her life 10. After my wifes death both the capital and income of the trust fund shall be held in trust for all or any my children or child who being sons or a son shall attain the age of twenty one years or being daughters or a daughter shall attain that age or marry under it and if more than one in equal shares 11. The investments hereby authorised are any stocks shares or securities in Which any part of my estate may be invested at the time of my death the stocks or securities of the Government of Great Britain or any British Colony or Dependency or of any Foreign State the bonds debentures debenture or preference stocks or shares of any company or corporation in Great Britain or any British Colony or Dependency or the United States of America and the security of any life interest in any real or personal property together with an insurance on the life 131.
