I MARGARETTA HARRISON of Saling Grove Braintree in the county of Essex widow MARGARETTA of' Captain Jasper Nicholls Harrison R M L
I Hereby revoke all testamentary dispositions heretofore made by me and declare this to be my last will which I make this . . . . day of . . . . one thousand nine hundred and eighteen
1. I appoint my daughter Margaret Harrison to be the sole EXECUTRIX of my Will and I appoint her and James Frederick Haynes Atkey of 9a Sackville Street London W Solicitor to be trustees of my Will and they and the survivors and survivor of then and the executors and administrators of such survivor or other the trustees or trustee for the time being hereof are hereinafter called the trustees or trustee
2. I bequeath the use and enjoyment of my family portrait said to be painted. by Sir G Keller and my old soup ladle and four silver salt cellars which have been in the Fowke family for many years to my cousin Villiers De Saussure Fowke during his life he keeping the same properly insured against fire and after his death I bequeath the said chattels to his son Villiers Loftus Philip Fowke absolutely
And I declare that the trustees or trustee shall not be concerned to see to such insurance or be liable for any loss or damage that may happen to the said chattels from any cause whatsoever
3. I bequeath to Frederick Walter Atkey my solicitor and trustee of my fathers Will the sum of one hundred pounds and to Captain William Harry Fowke Mauls of 70 Cheyney Court London S W 3 D.S.O. as trustee of my fathers Will the sum of one hundred pounds and I also bequeath to the said William Harry Fowke Maule as my godson the sum of five hundred pounds
4. I bequeath to each of my godchildren Livingston Shand and Janet Stratton the sum of thirty pounds and to each of my godchildren Eleanor Mosley Horace Jervis Richard Felthen Fagan and Maurice Malcomn Elrington the sum of fifty pounds and to my old servant Rose Garmstone the sum of twenty pounds
5. I bequeath to the trustees hereinbefore named the sums of five hundred pounds five hundred pounds and one thousand pounds upon trust that the trustees or trustee shall invest the same in the nameds of the trustees or trustee in any investments authorised for the time being by law as investments for trust money with power at discretion to dhange any such investments for others of a like nature and shall hold one of the said sums of five hundred pounds and the investments for the time being representing the same in trust to pay the income thereof to the said Villiers de Saussure Fowke during his life and after his death as to capital and income in trust for the said Villiers Loftus Philip Fowke absolutely and shall hold the other of the said sums of five hundred pounds and the investments for the time being reprsenting the same in trust to pay the income thereof to my cousin Mary Magdalen Maule during her life and after her death as to capital and income in trust for her son the said William Harry Fowke Maule absolutely and shall hold the said sum of one thousand pounds and the investments for the time being representing the same in trust to pay the income thereof to my cousin Margaret Ellen (commonly called Ella) Migliorini during her life and after her death as to capital and income in trust for her daughter Piera Elena Kelsall absolutely
6. I bequeath the several annuities following that is to say;
To my cousin Commander Moultrie Bickerton Fowke R N (retired) an annuity of fifteen pounds during his life To my cousin Sir George Henry Fowke an annuity of fifteen pounds during his life
To my cousin Edith Kelsall Elrington during her life and after her death to her husband Thomas Elrington during the residue of his life an annuity of fifteen pounds
To my cousin Nina Beatrice Fowke during her life an annuity of fifteen pounds
To my nephew Jasper Nicholls Hughes during his life an annuity of fifteen pounds
To my niece Mary Sophia Hughes during her life an annuity of twenty five pounds and
To my cousin Lucretia Kelsall during her life an annuity of twenty five pounds
7. I bequeath the several further annuities following to my old servants whether in my service at my death or not that is to say;
To Elizabeth Dangerfield during her life an annuity of one hundred pounds
To Emma Anne Bloomfield during her life an annuity of fifty two pounds
To Larriet Cornell during her life and annuity of fifty two pounds
To Clara Lucking during her life an annuity of fifty two pounds
To William Overall during his life and annuity of fifty two pounds
To Henry Byford (Senior) during his life an annuity of fifty two pounds
To Walter Railings during his life an annuity of forty pounds
To John Hales during his life an annuity of forty pounds and
To Annie Bowtle during her life and annuity of twenty five pounds
And I direct that if any of them the said William Overall Henry Byford Walter Railings and John Hales shall die whether before or after my death leaving a widow him surviving she shall take during the residue of her life while remaining his widow the annuity hereinbefore given to him
8. I declare that each annuity hereinbefore bequeathed shall commence from the day of my death and shall accrue due from day to day but shall be paid by equal quarterly payments the first of such payments to be made at the end of three calendar months from my death and I empower my trustees or trustee to provide for payment of any annuity hereinbefore bequeathed by setting apart as an annuity fund such investments as the trustees or trustee think proper to answer the same and any annuity so provided for shall cease to be a charge upon the residue of my estate and become charged solely on the income and capital of the investments so purchased or set apart and my residuary estate or the proceeds thereof may be distributed accordingly discharged from the said annuities and upon cesser of any annuity the annuity fund (if formed) or so much (if any) thereof as the trustees or trustee do not think it necessary to retain the answer any remaining annuity shall fall into and from part of my residuary estate
9. I declare that all specific and pecuniary legacies whether settled or not and annuities hereinbefore bequeathed shall be handed over and paid free of all death duties payable on my death but nor duties payable on the death of any tenant for life or annuitant
10. I devise and bequeath all the real and personal property whatsosver and Wheresoever of or to which I shall be seised possessed of entitled at my death or over which I shall then have a general power of appointment'or disposition by Will whether under the Will of my late father Thomas Thorpe Fowke or my marriage settlement of the twentieth September one thousand eight hundred and seventy nine or otherwise
(except property otherwise disposed of by this my will or any codicil hereto) subject to and after payment out of my personal estate or in case of deficiency thereof out of my real estate of my funeral and testamentary expenses and debts and the legacies and annuities bequeathed by this my will or any codicil hereto and the duty on any legacies or annuities bequeathed free of duty unto and to the use of the trustees hereinbefore named their heirs executors or administrators respectively upon trust for my daughter Margaret Harrison hereunto her heirs executors administrators and assigns
In witness whereof I have set my hand this twenty third day of July one thousand nine hundred and eighteen MARGARETTA HARRISON
