Recites (inter alia) Indentures of Lease, Appointment and Release of 1-2 Mar 1839 settling the land above (inter alia) including the Manor of Stevington and several farms (except parts subsequently acquired by exchange in 1850 (recited below) and a small portion which was waste of the Manor (see below) on Henry Frederick Alston, John James Kerr and George Leeke Baker subject to a term of 1200 years created by a Settlement dated 18 June 1816 for securing £10000 for portions for the younger children of Justinian Alston the older and the trusts of the term (except so far as such trusts were modified and controlled to certain uses for keeping on foot powers in the 1816 settlement during the life of JA senior) to HFA/JJA/GLB for 99 years (if JA senior should so long live) upon expressed trusts (recited), with several remainders over (recited), including trust to raise monies to discharge debts of JA senior etc.; power to borrow £10000 by way of Mortgage of the Odell Castle Estate; power to charge the same estate with raising portions under the 1200 year term; and trust for sale. Justinian's date of death remains confused between 1845 and 1848, the collator has taken it as the death certificate searched by Louis de Lassence 2023
Justinian Alston Death Certificate (12.01.1848) Im Jahre eintausend achthundert acht und vierzig, den zwoelften Januar um drei Uhr des Nachmittags sind vor mir Carl Boegner, Beigeordneter Civilstandsbeamten der Gemeinde Mainz, erschienen Siegmund Lorch, Weinhändler, neun und vierzig Jahre alt und Adam Schraub, Commis, neun und zwanzig Jahre alt, beide nicht verwandt mit dem Gestorbenen, zu Mainz wohnhaft und haben mir erklärt, daß Justinian Alston, königlich britanischer Major, sechszig und sechs Jahre alt, geboren auf Schloß Odell in England, daselbst wohnhaft, zu Mainz bisher temporär wohnhaft, Wittwer von Mary Kerr, im Leben zuletzt zu Schorndorf im Königreich Würtemberg sich aufhaltend, deßen Eltern und sonstige Verhältniße den Deklaranten unbe-kannt sind, heute den zwoelften Januar achtzehnhundert acht und vierzig um zwei Uhr Morgens, in dem Hause Lit. B. No. 174. Rheinstraße gestorben ist, und haben die Erklärenden gegenwärtigen Akt, nachdem solcher ihnen vorgelesen worden, mit mir unterschrieben.

On January 12th, 1848, at three o'clock in the afternoon, there appeared before me Carl Boegner, Alderman Civil Registrar of the Municipality of Mainz, Siegmund Lorch, wine merchant, forty-nine years old, and Adam Schraub, Commis, twenty-nine years old, both not related to the deceased, residing at Mainz, and have declared to me that Justinian Alston, Royal British Major, sixty-six years old, born at Odell Castle in England, domiciled there, hitherto temporarily domiciled at Mainz, widower of Mary Kerr, last living at Schorndorf in the Kingdom of Württemberg, whose parents and other relations are unknown to the decla-rants, today January 12th, 1848 at two o'clock in the morning, at the house Lit. B. No. 174. Rheinstraße, and the declarants have signed with me the present act, after it has been read to them. I hereby certify that Mr Justinian Alston of Odell Castle, in the County of Bedford, now residing in Mannheim, Batchelor, and Miss and Hepburn Mercer, daughter of the late Alexander Hepburn Mercer and Jane Keith Isabella his wife, late of Edinburgh, now residing at Mannheim, spinster, were duly married according to the Rites of the Church of England, in the house of her Britannic Majesty's Minister Plenipotentiary at Frankfurt this 26th day of October in the year of our Lord 1841. 2. Justinian Alston Jnr: Belgium Passport, 18 Apr 1842. Passport "Au nom du roi des Belges": was delivered by the Belgian consulate in London on April 18th, 1842 to Justinian Alston Jr. He had married Anne Mercer in October 1841 in Frankfurt. They then went to England. This passport allowed them to return to Germany through Belgium "with all their luggage". On the back, it is noted that they then left Mannheim for Baden-Baden on August 2nd, 1842, where Justinian died in October 1845. Document courtesy of L de Lassence - 2022
