BENTHAM v. ALSTON. Bill, 13 May 1689, by Joseph Bentham, clerk, rector of Stevenage, co. Herts., v. John Alston, John North and William Titmus. About 3 years since Fulk Tudor, D.D., deceased, late rector of Stevenage, made a demise to John Alston of Stevenage, gent., and the other defendants of the glebe lands of Stevenage and the tithes. The complainant has confirmed the lease, but defendants refuse to pay rent since the death of Dr. Tudor. Answer of John Alston, gent. 30 Oct. 1689 He declares the lease was terminable on the death of Dr. Tudor, if it occurred (as was the case) within the term of three years for which it was payable.
