1. William Foster Vesey Fitzgerald: Will, 29 Apr 1891.
I WILLIAM FOSTER VESEY FITZ GERALD of Moyvane in the county of Kerry and of Arnold Villa Rugby in the county of Warwick in England Esquire revoking all testamentary dispositions heretofore made by me declare this to be my last will and testament Whereas under the provisions of an Indenture of Settlement bearing date the twenty eighth day of May one thousand eight hundred and forty seven executed prior to my marriage I was empowered to appoint unto or for the benefit of my children a sum of nine thousand and fifty seven pounds seventeen shillings and two pence three per cent consolidated Bank annuities and also the further sum of four thousand five hundred pounds in the said settlement mentioned subject to my wife's life estate in the income thereof in case she shall survive me And whereas my estates situate in the Barony of Iraghticonnor in the County of Kerry stand charged by an indenture dated the twenty first day of January one thousand eight hundred and forty seven with the payment of the sum of four thousand pounds and interest thereon And whereas on or about the first day of March one thousand eight hundred and sixty nine the said sum of four thousand pounds and the securities for the same were assigned to the trustees of the said Marriage settlement in consideration of that sum then advanced by them at the joint request of me and of my said wife out of the said sum of nine thousand and fifty seven pounds seventeen shillings and two pence Consolidated Bank annuities And whereas by Indenture bearing date the twenty first day.of April one thousand eight hundred and sixty five the said sum of four thousand five hundred pounds and the sum of four thousand six hundred pounds making together the sum of nine thousand one hundred pounds was secured to the then trustees of the said Settlement by a mortgage on my Clare Estate And whereas of the said sum of four thousand six hundred pounds the sum of two thousand six hundred pounds only was advanced to me by said trustees as appears by a certain Deed bearing date the first day of April one thousand eight hundred and seventy eight made between me my wife and children and the trustees of the said settlement and the residue of the trust funds (over and above said sum of four thousand pounds and seven thousand one hundred pounds of the said sum of nine thousand one hundred pounds) was at the date of said last mentioned deed represented by a sum of seven hundred pounds seven shillings and ten pence Stock of the Governor and Company of the Bank of Ireland And whereas said sum of seven hundred pounds seven shillings and ten pence Bank Stock was afterwards sold out and the sum of two thousand and one pounds six shillings and eleven pence was invested in the purchase of the lands of Jellewstown in the county of Meath and the Impropriate Tithes or rent charge in lieu of tithes amounting annually to the sum of sixteen pounds and ten pence chargeable upon the townland of Artnalevery in the parish of Charlestown in the Barony of Ardee and county of Louth and same were conveyed to the then trustees of said settlement by Indenture bearing date the fourth day of June one thousand eight hundred and eighty seven And the Trust fund is now represented by said mortgage for four thousand pounds on my Kerry Estate seven thousand one hundred pounds secured by mortgage on my Clare Estate and by the said lands of Jellewstown and Tithe rent charge so purchased as aforesaid And whereas I have by deed poll bearing date the twentieth day of April one thousand eight hundred and ninety one appointed the sum of four thousand pounds so secured on my Kerry Estate to my eldest son John Vesey Foster Vesey FitzGerald And whereas by Indenture bearing date the twentieth day of April one thousand eight hundred and ninety one I appointed said lands of Jellewstown and said Tithe rent charge to my said eldest son And whereas I am desirous of appointing said sum of seven thousand one hundred pounds portion of the trust funds secured by said Indenture of the twenty first day of April one thousand eight hundred and sixty five in manner hereinafter mentioned Now I hereby in exercise of said power of appointment subject to the life estate of myself and my said wife and to the several uses trusts and powers in the said recited settlement contained declare and appoint that the trustees of my said settlement shall stand and be possessed of said sum of seven thousand one hundred pounds and the securities for the same In trust as to five hundred pounds portion thereof for my second son William Vesey FitzGerald Foster Vesey FitzGerald and the sum of five hundred pounds other portion thereof for my third son Henry Martin Foster Vesey FitzGerald and the residue thereof for my eldest son John Vesey Foster Vesey FitzGerald absolutely I bequeath to my beloved wife to meet her immediate expenses the sum of three hundred pounds I bequeath to my second son William Vesey FitzGerald Foster Vesey FitzGerald. the sum of one thousand five hundred pounds and to my third son Henry Martin Foster Vesey FitzGerald a like sum of one thousand five hundred pounds and I direct that the said three several last mentioned legacies shall be paid out of my personal estate as soon after my decease as may be reasonably practicable in case same shall be sufficient for the purpose and in case same shall prove insufficient then I charge said legacies or so much as my personal estate shall be insufficient to pay upon the real estate hereinafter devised to my eldest son as residuary devisee I bequeath to my wife the Plate pictures and trinkets carriages and horses and all the furniture and personal effects of every kind in and about my usual residence in England at the time of my decease any money and securities for money which I direct shall form part of my residuary personal property I devise to my beloved wife absolutely my property in Market Street Church Street and Kings Head Street in the town of Harwich and also at Dover Court Green in the parish of Dover,Court both in the county of Essex together with all arrears of rent due thereout at my decease and as to all the rest residue and remainder of my real freehold and personal estate not hereinbefore disposed of I devise appoint and bequeath the same together with all arrears of rent of said real estate to my said eldest son and I appoint him my Residuary Legatee and Devisee I direct that all sums of money charged upon my real estate shall be paid by my eldest son out of the real estates which at the time of my death shall be respectively charged therewith in exoneration of my personal property I declare that any benefits which my beloved wife may take under this my will are intended by me and shall be accepted by her in full discharge of any claims or demands legal or equitable which she may have against me on any account whatsoever
I appoint my beloved wife and my eldest son John Vesey Foster Vesey FitzGerald EXECUTRIX and EXECUTOR of this my will
