On the death of her half brother Robert Marsden Fitzgerald Emily inherited a one fifth share of his estate and in 1922 her husband bought out the other 4 shares of Dabee, a property originally owned by her grandfather Richard Fitzgerald, and which is still owned by her grandson Richard Kelynack Evans.

Will of Emily Fitzgerald 29 Nov 1922 EVANS Emily Fitzgerald late of Epping widow. this is the last Will and Testament of me Emily Fitzgerald Evans of Sydney in the State of New South Wales Widow of the late George Evans of Sydney Solicitor I revoke all other Wills at any time heretofore made by me I bequeath to my old friend and Solicitor Arthur Nelson Littlejohn of Sydney aforesaid as a small appreciation of his unvarying affection to me and especial services during many years and also on account of my regard and esteem a sum of one thousand pounds (L1000) to be paid without any . . . . . or deduction in priority to all other legacies gifts devises and bequests and as to all the residue and remainder of my estate property and effects both real and personal I give and devise and bequeath the same to my son Robert Fitzgerald Evans absolutely and for ever and I comment to the special attention of my said son as included in my residuary personal estate the furniture household effects and stores at Dabee Station near Rylstone which were either the subject of gift to me my late brother or were purchased by me from his estate and I declare that I . . . . . my Will in the above terms because during my lifetime I have by gift and settlement made the fairest and most ample provision for all my children and I consider that what little my residuary general estate may yield should in fairness to my said son Robert Fitzgerald to make up to him for what he should have received first out of his late grandfathers estate and secondly out of his said late father's estate and I appoint Perpetual Trustees Company Limited of Sydney to be executors of this my Will as Witness my hand at Turramurra (?) this twenty ninth day of November one thousand nine hundred and twenty two. 21 November 1929 On this date Probate of the Last Will and Testament of the said deceased was granted to Perpetual Trustee Company Ltd. the sole executors in the said Will named Testrix died 19 August 1929 Estate
Emily had issue 4 sons and 2 daughters.
Emily married George EVANS [11354] [MRIN: 3796], son of George Edwards EVANS [11432] and Sarah HAMMON [11433], on 27 May 1868 in St Michaels Surry Hills Sydney. (George EVANS [11354] was born on 11 Apr 1839 in Clerkenwell MDX, baptised on 4 Jul 1852 in St Sepulchre Holborn LND and died in 1910 in Randwick NSW.)
