HUTCHINSON v. ALSTON. Depositions : Richard Hutchinson the elder and younger, v. Samuel Alston and Judith his wife, Samuel Alston their son, (and others) and Edw. Alston, clerk. The interrogatories only are here ; the suit relates to right of common, &c., on Newton Green, near Sudbury, co. Suffolk ; the father of the elder Alston defendant, viz : Samuel Alston, deceased, was tenant in the manor of Newton Hall. The 20th interrogatory refers to an indenture of 4 Dec. 1639, between Isaac Crewe of Lavenham on the 1st part, Edmund Alston the elder of Newton, gent., of the second part, and Samuel Alston, gent., his second son, as to the uses of a recovery lately had of a tenement called Deans in Newton, &c., &c., viz : to the use of the said Edmund for life, with remainder to his said son Samuel. Edward Alston was brother of the said Samuel. Bridges. 544. 1690(?)
HUTCHINSON v, ALSTON. The further answer, dated 8 July 1691, of Bernard Carter, gent., and Edward Allston, clerk, two of the defendants to the complaint of Richard Hutchinson the elder Esq. and others. The defendent Carter has read over all court rolls and deeds to which he has access relating to the premises mentioned in the bill, and finds that Edmund Alston decd., one of the sons of Samuel Alston in the bill named, granted a lease of a parcel of land in Newton co. Suffolk, to Thomas Carter in June 1687, his title to which was derived from the will of the said Samuel Alston, which defendant believes was proved at Bury St. Edmund's. Searching among his deeds this defendant found an old one dated 20 October 14 Elizabeth, wherein one Roger Warren granted several lands and tenements in Newton to one Edward Alstone of Edwardstone, co. Suffolk ; he has also found an old will dated 22 April 1631 [2804] made by Samuel Alston, uncle, he believes, of the said Samuel in the bill mentioned, in which are several bequests of land in Newton. HUTCHINSON v. ALSTON. Depositions of witnesses taken at Sudbury in Suffolk 6 April 1692, being answers to the interrogatories preserved in Bridges 544 q.v. Richard Hutchinson the younger is lord of the manor of Newton Hall. Samuel Alston decd., father and grandfather of the two defendants Samuel, was known to John Balls of Newton, a deponent, for forty years and upwards as an inhabitant of Newton, and tenant of several messuages, &c., in the parish of Newton Hall ; he has been dead about three or four years past, and was buried in Newton parish church. Mr. Edward Alston, brother of the deceased Samuel, was a copyhold tenant of the said manor for 40 years and upwards: and during that time was an inhabitant of Newton parish. Mr. Thomas Alston is now tenant of Newton Hall. A parcel of land in Newton called Bansilers, formerly the land of the said Samuel Alston deed,, descended on his death to his daughter Dorothy, one of the defendants, now wife of Henry Stilleman. This land and other parcels were the proper inheritance of the said Samuel. Thomas Alston of Newton, co. Suffolk, gent., aged 41, is a deponent ; he has known the manor of Newton for nearly 40 years past. Samuel's death was returned at a court held for the manor of Newton Hall on or about 5 Feb. 1689/90;. Edward Alston decd. was deponent's father, and died about two years since at Newton. Edward Alston, clerk, Henry Stilleman and Dorothy his wife, Samuel Alston and Judith (sic) his wife, Samuel their son, Samuel Goldsmith and Thomas Hamond. The suit relates to rights in Newton Green, possessed by the inhabitants of Newton.
