ALSTON v. COYSH (or COSH).
Bill, 3 November 1687, by Edmund Alston of . . . . . co. Surrey, gent., and Jane his wife, late wife of Robert Sewell, late of London, Esq. decd., v. Sarah Cosh and James Gosh.
By indenture dated 25 and 26 July 1664, in consideration of a marriage then shortly to be had between the said
Robert and Jane, daughter of Bruice Ryves, D.D. (to which indenture John Ryves of London, merchant, was a party) the said Robert settled property in Braintree, Essex, to provide a jointure for the said Jane. But one Elisha Coysh Dr. of Physic, with others unknown, have conspired to defraud said Jane of her jointure, and prevailed with
the said Sewell to mortgage or demise the said property to him for a long term of years.
Sewell died in or about une 1686.
Defendants are wife an if son of the said Elisha decd.

Part of the Will of Edmund Alston 1689
In one name of God Amen I Edmund Alston of Lambeth in the county of Surrey Gent being in health of body and of sound memory praise be to God make this my last Will and Testament in manner following (viz) Imprimis I give and bequeath unto William Curd of Newton in the county of Suffolk single man and unto his heirs and assigns for ever all those three Messuages or tenements now or late in the several occupations of William Woolaston Frances Saurer and John Vintior? with all the yards and appurtenances whatsoever to them or any of them belonging or appleyning situate lying and being in Newton aforesaid upon the condition that the said William Curd his heirs or assigns do pay to the executrix of this my will upon demand the sum of seven and twenty pounds and nineteen shillings of lawful money of England in part towards the payment of fifty pounds of like money which I have agreed with Samuel Alston my brother to pay in and to of such monies as are due to Dr Trumbal upon a mortgage which was made to him by my late lamented father Samuel Alston deceased. And for default of payment of the said seven and twenty pounds and nineteen shillings by the said William Curd his heirs or asigns upon demand Then I give the said three messuages or tenements and other the premises with their appurtenances unto Jane by loving wife her executors administrators and assigns in trust and to the intent and purpose that the said Jane her executors administrators and assigns as soon as may be after my decease may sell the said three messuages or tenements and other the premises to the best advantage that may be and use an imploy the moneys arising upon sale thereof and the rents arising before sale thereof (if any further shall be) towards the repayment of the aforesaid sum of fifty pounds. Item I give and bequeath unto Bernard Carter of Sudbury in the county of Suffolk gent and his heirs and assigns for ever all that piece or parcel of arable copyhold land lying in Newton aforesaid and abutting westward upon the Kings Highway leading from Newton Green to Cornard Heath containing by estimation three acres be it more all less holden of the Lord of the Manor of Buttlers by occupy of court roll with all and singular the rights members and appurtenances thereto belonging or appleying upon condition that the said Bernard Carter his heirs or asigns do pay to the executrix of this my Will her executors administrators or asigns the sum of two and thirty pounds of lawful money of England upon demand (or any further other sum as my said executrix her executors administrators or assigns shall be fully satisfied with and I Will that out of the moneys which shall be paid by the said Bernard Carter to his heirs executors or assigns the moneys which shall arise of the aforesaid three messauges or tenements shall be made up fifty pounds and shall be used for the satisfying and repaying the aforesaid fifty pounds which I have agreed as aforesaid to pay according to the due intent and meaning of my beforementioned agreement with my said brother Samuel Alston also performing what was agreed upon on his part for the benefit of my as executors and assigns and all the residue and surplus of such monies as aforesaid I give to the said Jane my wife and my child which she is now with. And in case the said Bernard Carter his heirs or assigns refuse to pay the aforesaid sum of two and thirty pounds (or such other some as shall be satisfactory to the executrix of this may will or her . . . . .


Precis of the Will of Edmund Alston of Lambeth, gentleman
Dated 16 Nov 1687
To William Curd of Newton, Suffolk, bachelor three messuages now or late in the occupation of William Woolaston, Francis Spencer and John Vintner paying L27 19s towards the L50 I have agreed with Samuel Alston my brother to pay of money due to (Dr) Trumbal on mortgage made to him by my late father Samuel Alston, deceased and for default said three messuages to my wife Jane Alston in trust to sell same to pay the L50;
To Bernard Carter of Sudbury, Suffolk, gentleman parcel of copyhold land in Newton abutting westward on the road from Newton Green to Cornard Heath (3 acres) held of manor of Buttlers paying exec. L32 to be used to satisfy the L50 above and residue to my wife and child she carries; to my wife after death of my uncle Hamlet Fryar half of right by will of my grandmother Ellen Fryar, deceased and will of brother Fryar Alston deceased reversion of land to child my wife pregnant with; half all messuage in Newton copyhold and freehold to my wife, exec. and other half to child my wife pregnant with . . . . .
