ALSTON v. HOVELL alias SMITH. Bill 18 June 1692, by Edmund Alston of Newton, co. Suffolk, gent. v. John Hovell alias Smith. Orator was seised of an estate of inheritance either in his own right or in right of Jane his wife in a messuage called the Crown, in Cleydon, and lands &c. in Claydon, Bayleham and Coddenham, co. Suffolk, in the occupation of John Hovell alias Smith of Barrham, said co., clerk, (and another) ; and agreed to sell the same to defendant for L80 The only copy of the agreement is in the hands of defendant, who refuses to allow Orator to have a sight of it, but has prepared the draught of a penal bond to compel conveyance to be made, though Orator is and has always been willing to make legal conveyance at any time. ESTWICK v. ALSTON. Bill, 7 July 1699, by Esther Estwick of Hackney, co. Middx., widow, v. Edmund Alston, son of Edmund Alston, deceased, and John Cooke. Complamant is possessed (under the will of Isaac Estwick, late of London, merchant) of lands &c., in Newton near Sudbury, Edwardstone and Waldingfield, co. Suffolk, One parcel of land called the Slikett adjoins the defendant Alston's estate,. and John Cooke is tenant thereof; they conspire together to defraud complainant of the same (by means not specified). ESTWICK v. ALSTON. Esther Esthwick. widow, v. John Cooke and Edmund Alston, an infant (by his guardian). Depositions taken at Sudbury, Suffolk, 31 January 1699. The suit relates to the possession of a small piece of land in Newton, with right of way ; the Alstones have held Roger's farm in Newton for three generations, Edmund Alstone, father, and Edmund Alstone, grandfather, of the defendant Edmund, having held it before him. The Will of Edmund Alston of Newton in Suffolk Dated 20th Nov. 1694. I give to Jane my wife for her natural Life in lieu and full satisfaction of her dower and thirds all my freehold Messuages, Lands Tenements and Appurtenances lying in Newton, and Gt. Waldingfield and Boxford in Suffolk to keep in good repair and after her decease unto Edmund Alston my son and his heirs. I also give to Edmund Alston my son and his heirs the manors of Newton, Buttlers and Codnum Hall with this proviso that the said Jane shall receive and take the Rents Issues and profits thereof for and towards the nourishing and bringing up the said Edmund Alston and paying all Debts and keeping all premises in repair until my said son Edmund shall attaine the age of 24 years, or happen to be married allowing and paying to him or his Assignes out thereof L20 every year, otherwise to Jane my wife and her heirs and assigns for ever. I give to Dorothy Alston my Daughter all my Messuage Lands and Tenements situate in Edwardstone in Suffolk, But my desire is that my said daughter Dorothy and her guardian should permit and suffer the said Jane my wife to have and take so much of the first year's Rents and profits after my decease as by the judgment of John Cooke of Eclwardestone can conveniently be spared over and above the charges of maintaining my said daughter and putting all the bequeathed premises into good and Tenantable repair If my said wife Jane shall deny or refuse my said Daughter Dorothy to have and hold all such things then I give them to Edmund my son when he come to the age of 21. I give to the said Dorothy one Wainscotted Bedstead, one of the best feather bedds that lye upon the garrett in the house where I now live, one feather Bolster, two feather pillows, two Blanketts, one Coveriett, one pair of Sheets one pair of Pillow-beers., and foure Gold rings which were her mothers. I also give unto Jane my wife all my Corne, Graine, Hay, Cattle, and Goods for payment of my Debts and Legacies and I doe order that she pay thereout and out of the Annual profits of the Estate L30 per Annum I give unto Jane my wife All my household goods (not before bequeathed) to make use of during her life and after her decease, and to my wife's Son Isaac one Silver Tankard marked W.M.N. and seven Silver Spoones and to my Son Edmund my Watch and one Silver porringer and all my other Plate and other household goods which I had before the Inter-marriage with the said Jane my wife, to him the said Edmund, and all other household goods which I had by the said Jane my wife mentioned in a schedule hereunto annexed I give to be parted equally between the said Isaac and Edmund. If she the said Jane shall happen to marry again I doe give and order that she give security to the Trustees and supervisors of this my will. If she neglect or refuse then to the said Isaac and Edmund so soon as she the said Jane shall marry again. I give to Jonas Worly of Witham in Essex and John Cooke of Edwardstone in Suffolk 40s. each. I do nommate the said Jonas Worly and John Cooke supervisors of this my will. I do order that my son Edmund be brought up according to these directions I appoint the said Jane my wife sole executrix.
