Will of Jonadab Toller of Stanway
1st Feb 1722
In the name of God Amen I Jonadab Toller of Stanway in the County of Essex Yeoman being weak and infirm in body but of sound and disposing mind and understanding blessed be God for the same do make and declare my last Will and Testament to be as follows In the first place I commend my soul unto the hands of God and my body to decent Christian burial at the discretion of my executors herein after named Hoping for a joyful resurrection to Eternal life through the alone merits and mediation of Jesus Christ my only Saviour and Redeemer And as to such temporal and worldly estate as it hath pleased God in his mercy to the bestow on me I dispose thereof as followeth And first I Will and order that my debts be paid out of my personal estate and after payment of my debts and the legaryes herein after given away and bequeathed I give all the rest residue and remainder of my personal estate whatsoever and wheresoever to my loving wife Elizabeth Toller and to her assigns Item I give and bequeath to my daughter Elizabeth Toller and to her heirs all my Lands tenements and Hereditments both freehold and copyhold situate lying and being in the parishes of Stanway aforesaid and Copford or in any other parish or parishes in the said County of Essex But in case my wife shall happen to be enseint (enceinte) or with child at the time of my decease and such after born child be a son Then I give all the said Lands and tenements above given to and devised to my said daughter Elizabeth Toller to such after born son and his heirs Sonn paying and thereout unto my said daughter Elizabeth at the age of one and twenty years the sum of one hundred pounds of Lawful British money and if it shall happen that such after born son shall not pay the said sum of one hundred pounds to my said daughter Elizabeth according to the tenor of this my Will then my Will is that my said daughter shall have power at any time within three months next after such after born son shall have attained his said age of one and twenty years To enter into and upon all and every my said freehold and copyhold Lands tenements and Hereditments and to have take and receive the rents issue and profits thereof and of every part thereof to her own use until she shall be fully satisfied the said sum of one hundred pounds with interest for the same from the time of his attaining his said age of one and twenty years and all costs and charges and damages which she shall be put to in the recovery of the same or sustained by reason of the non-payment thereof. But in case my wife be enfeint or with child at the time of my death and such after born child be a daughter then I give and bequeath my said freehold and copyhold Lands tenements and Hereditments to my said daughter Elizabeth and to such after born daughter and to her heirs and assigns forever as tenants in common and not as joynt tenants And my Will is that my wife shall be Guardian to such child or children and shall receive the rents issue and profits of my said estate for their maintenance until he she or they shall attain his her or their age or ages of eighteen years without any account to be given to him her or them she keeping the premises in good repair and committing no waste and from and after such child or child or children shall have attained their age of eighteen years my Will is and I do hereby give unto my said wife a rent charge.
of eight pounds a year during her natural life to be paid to her half yearly out of all my said Lands tenements and Hereditments by such child or children and their heires as shall enjoy the said Lands tenements and Hereditments and in case of non-payment I do hereby empower and authorise my said wife to enter into and upon all and every of my said Lands and Hereditments and to take and receive the rents issues and profits thereof until she shall be fully paid and satisfied all arrears of the said rent charge of eight pounds together with all costs and damages which she shall be put to by reason of the non-payment thereof But in case my said daughter Elizabeth and such after born child (if such there be) die under the age of one and twenty years leaving no child or children lawfully begotten then I give my said Lands tenements and Hereditments both freehold and copyhold to my said loving wife for during the term of her natural life and after her decease I give the same Lands tenements and Hereditments to such child or children of my cousin Thomas Wills/Wells as shall be then living and their heirs as tenants in common and not as joynt tenants And my Will is that no timber be felled out of any of the Woods belonging to my estate during the minority of my child or children or in the lifetime of my wife in case my said estate ever comes to her for her life. Item order that my executors do out of my said personal estate pay to my friend John Eldred of Colchester gent the sum of five pounds of Lawful British money in recompense of several services which he hath done for me Item I give and bequeath to my cousin Peter Purkis the sum of twenty pounds of like Lawful money to be paid to him at his age of four and twenty years and I do hereby revoke all former and other Wills by me formerly made and do declare this to be my last Will and Testament and of this my Will do constitute and appoint my said loving wife Elizabeth Toller and my loving friend Aryon Tegue? Jnr of Aldham Yeoman executors of this my Will and give to him the said Aryon Tegue the sum of ten pounds in consideration of his pains and trouble in the execution of this my Will and I give to my friend Robert Potton my bas bolt hilted Sword which was my Lord Cravens In witness whereof I have to this my Will written on two sheets of paper set my hand and Seale to each sheet this first day of February in the year of our Lord one thousand seavon (sic) hundred twenty and two.
Signed sealed published and declared by the testator herein named to be his last Will and Testament in our presence and we subscribed our names as written - hereabouts in the presence of the said testator
