THE WILL OF ELIZABETH ALSTON OF NEWTON.
Dated 20 July 1770.
This is the last Will and Testament of me Elizabeth Alston the wife of Edward Alston of Newton in the county of Suffolk Gentleman being of sound mind memory and understanding Thanks be to Almighty God for the same made in manner following that is to say Whereas by Indenture of Lease and Release bearing date respectively on or about the first and second day of February 1744 the Release being Tripartite and made between the said Edward Alston of the first part . . . . . the said Elizabeth by the name Elizabeth Toller of Stanaway in the County of Essex spinster of the second part and Elizabeth and Elizabeth See of Stanaway aforesaid widow and John Brown of the same planc. . . . . Gentleman of the third part I the said Elizabeth Alston have a power and authority given me in and by the said Indenture of Release to Dispose of by Will certain freehold messuages lands tenements and hereditaments with their appurtenants situate in Stanaway Coptford or Lexden or elsewhere in the County of Essex to the use of such child or children of me the said Elizabeth Alston by the said Edward my husband to be begotten as I should think proper And whereas I the said Elizabeth Alston by a certain Surrender bearing date on or about the second day of February 1744 did surrender all and singular my Copyhold messuages lands Tenements and hereditaments whatsoever Holden of the Manor of Coptford (amongst other uses) to the use of such child or children of me the said Elizabeth by the said Edward to be begotten As I the said Elizabeth should give the same by my Will now I do by the virtue of the powers and authorities given me as aforesaid Give and devise to my two daughters Elizabeth Alston and Lucy Alston all those the aforesaid freehold messuages lands Tenements and hereditaments with their and every of their appurtances situate in Stanaway Coptford and Lexden aforesaid or in any other Parish or Parishes next or near adjoining and also all and singular my copyhold messuages lands tenements and hereditaments whatsoever holden of the Manor of Coptford and all other my freehold and copyhold lands tenements and hereditaments in the County of Essex and now in the tenure or occupation of John Oakely his . . . . . or assigns To hold all the said freehold and copyhold premises to them my said two Daughters Elizabeth Alston and Lucy Alston and to their heirs and assigns for ever share and share alike and to take as tenants in common and not as joint Tenants Chargeable nevertheless and I do hereby expressly charge all the above mentioned freehold and copyhold premises with the payment of the sum of L200 unto my daughter Judith Alston within twelve months next after my and my husbands decease and in case my said daughter Judith be under the age at the time of my and my husbands decease then I do hereby order and direct that my said daughters Elizabeth Alston and Lucy Alston or one of them shall pay or cause to be paid unto my said daughter Judith Alston lawful interest for the said sum of L200 half yearly until she attains her said age of twenty one years and in case the said sum of L200 and interest as aforesaid or any part thereof shall be unpaid by the space of 40 days next after the same or any part thereof to be paid as aforesaid that then and from henceforth it shall and may be lawful to and for the said Judith Alston to enter into and upon the said farms lands and premises charged therewith as aforesaid or any part thereof and to hold and enjoy the same and to receive and take the rents fines and profits thereof until the said sum of L200 with interest as aforesaid together with all the costs and charges which shall be sustained by reason or occasion of any such default of payment shall be paid and satisfied and in case the said Judith Alston shall depart this life before she arrives at the age of twenty one years (leaving no issue lawfully begotten) then my will is that the said sum of L200 shall be equally divided amongst my children share and share alike and to take as Tenants in Common and not as Joint Tenants and my mind and will further is and I do hereby order and direct that in case either of my said daughters Elizabeth Alston and Lucy Alston shall depart this life before she or they arrive to the age of twenty one years and dying without issue lawfully begotten then I give such share of the said freehold and copyhold estate so devised as aforesaid of such deceased part to be equally divided amongst such of my children that be then living share and share alike and to take as tenants in common and not as joint tenants and I do hereby make nominate constitute and appoint my said loving husband Edward Alston and my said Eldest son Edward Alston joint Executors of this my last Will and Testament and I do hereby revoke all former Wills and Testamentary Dispositions by me at any time made and do declare this to be my last Will and Testament. In witness whereof I the said Elizabeth Alston have to this my last Will and Testament contained in three sheets set my hand to the first two sheets thereof and to the third sheet thereof my hand and seal and also my seal to the tape which affixes the same together at the top this 20th day in the 10th year of the reign of King George the Third and in the year of our Lord one thousand seven hundred and seventy

Codicil: To my last Will and Testament and whereas by my said last will I have given and bequeathed to my two daughters Elizabeth and Lucy all my copyhold and freehold estates lying in Stanaway Lexden and Coptford by this present Codicil I give and bequeath the said copyhold and freehold estates to be equally divided between my three daughters Elizabeth Lucy and Judith as witness my hand this tenth day of July 1775

Elizabeth married Edward ALSTON  [MRIN: 1279], son of Nicholas ALSTON  and Elizabeth FAIRBROTHER of East Bergholt , on 2 Feb 1743/44. (Edward ALSTON  was christened on 2 Jul 1712 in Newton Nr Sudbury SFK and was buried on 16 Oct 1785 in Newton Nr Sudbury SFK.)
