Suffolk, who was son and heir of William Alstone, late of Newton aforesaid, the common ancestor and great great grandfather unto your Orator and great grandfather to Mary Alstone, late Lady Hanmer, which said Mary was daughter and heir of Joseph Alston, late of Sicklemore House in the parish of Bramford, Esq., son and heir of Edward Alstone, late of Boxford, second son of Orator's said great great grandfather. v. Middlesex decd, by her will dated 24 February 1696/7 appointed the defendants her trustees of the said lands (lying in Bramford and Blackenham, co. (469/2 1709/10) Defendant Buckeridge says that Lady Hanmer has paid most of the debts of Dorothy Warner, deed, out of her own estate. Thomas Alstone says that as Dame Mary Hanmer is dead without issue, the property remains vested in himself and Buckeridge in trust for the heir at law of the said Dame Mary. WARNER v. ALSTON. Bill, 4 April 1712, by Edmund Warner, an infant (by John Upton of London, merchant his next friend) v. Samuel Alston, William and Elizabeth Alston, Susan Robinson, Thomas Alston, Bambridge, Buckerrdge and John Mountague. Joseph Alston of Washbrooke, Suffolk, decd., who was seised of manors and lands in Suffolk to the value of L1000 per annum, married Mary, one of the daughters of Edward Warner, Esq. (the great grandfather of complainant) and aunt of Edmund Warner, Esq. decd., complainant's late father, who brought him a considerable portion in marriage, and by whom he had issue only two daughters, Mary and Susanna, which Susanna died an infant. ( The provisions of Joseph Alston's Will are set forth.) The daughter Mary married Sir John Hanmer, bart., and they enjoyed the estate of the said Joseph, Sir John died about 1700 ; and Dame Mary his wife died intestate, without issue in 1709, and the estate should remain to complainant as cousin and next heir of the said Dame Mary, viz., as son and heir of the said Edmund, her only surviving nephew. But the writings have come into the possession of Samuel Alston, gent., who confederates with his son and daughter William and Elizabeth, and with Sarah Robinson, who attended Dame Mary in her last sickness, and others, to defraud complainant. The greater part of the premises are copyhold. The Alston defendants in their answer say that all that remains of Joseph Alston's estate, is property in Bramford and Blackenham on the hill, worth about L290 per annum. They believe Mary Warner brought no marriage portion to her husband. They claim under the will of Dorothy Warner (sister of Dame Mary). Hamilton. 383/22. 1712, Alstoniana Pg 217
